Adding a captains price to your offers when operating as a bareboat charter may seem to be in contradiction to USCG guidance regarding bareboat charters and selection of crew. So let's clarify the important elements to be aware of.
1) Bareboat charter agreement - It is essential to have a written bareboat charter agreement that incorporates terms relating to the captains requirement. If you typically recommend captains to the charterer, they must be listed here with express clarity that the charterer does not HAVE to choose from this list. 2) NVIC 7-94 -
The charterer must have the option of selecting the crew. Although a master or crew may be furnished by the owner, full possession and control must be vested in the charterer. This does not preclude the charterer from taking advice from the master and crew regarding hazardous conditions such as inclement weather, navigational obstructions, etc.
CG Interpretation: The charterer MUST have the authority to hire their own crew, even if the crew they hire is not on the furnished list of master or crew recommended by the owner or the owner's representative. The list must have at least 2 options with no language to promote preferential treatment of a specific selectee(s). The owner, owner’s representative, or third-party MAY require the captain to provide proof of completion of a state-approved boating safety course or a merchant mariner credential appropriate for the size and type of vessel being chartered, thus proving minimum level of competency.
3) How the charterer selects the crew when using the feature -
When you send an offer to the charterer that includes a price for the independent captain you will still need to take steps to ensure you remain compliant. The charterer must still be furnished with a list of recommended captains and be allowed to choose which one they want to use. We recommend using the Getmyboat messaging system to send this list so that there is full record of the communication. If the charterer wishes to provide their own captain, you may stipulate that they have a minimum level of qualification to charter the vessel. Ultimately you CANNOT dictate the captain the charterer chooses
4) How the captain is paid -
Getmyboat will ensure the captain is paid directly from the booking funds sent by the charterer. These funds go directly to the captain.
